UPDATE IN THE “SECTION 1127" CASE

On March 9, 2000, a hearing was held in New York Supreme Court before Justice Stanley Sklar in the case of Ganley et. al. v. Giuliani et. al.  (i.e., the “Section 1127" case involving former members of the New York City Transit and Housing Authority Police Departments).  Judge Sklar reserved decision on the matter until a future date.

The Judge demanded that the City pay the original named Petitioners “with all deliberate speed,” in accordance with the Court of Appeals decision, dated November 30, 1999.   However, the Judge reserved decision on whether the Ganley decision applied to former Transit and Housing members not named in the original law suit.  Additionally, the judge reserved decision on whether any interest would be applied to the monies owed.

Before concluding the hearing, Judge Sklar indicated that he would try to render a decision in a timely fashion, but stressed that it would take some time.  We expect that officers who were named in the original suit will be receiving checks from the City for the principal amount owed to them within the next two (2) months. 

We will inform you as soon as the Judge renders his decision.
