Summary of the PBA Delegates Meeting

CALL TO ORDER

PBA President Patrick Lynch called the meeting to order at 11:20

  • Salute to Flag
  • Respects to all fallen officers, seriously injured officers and those who stand wrongfully accused.

  • Recording Secretary Robert Zink reported opening correspondence.

REPORT OF JOE MACCONE

  • Mr. Maccone reported that a tentative agreement had been reached between the City and the PBA regarding “restart” money and pension improvements, including Increased Take Home Pay (ITHP) and Final Average Salary legislation.  Certain conditions still need to be satisfied before the agreement is finalized.

PRESIDENT’S REPORT 

  • PBA President Patrick Lynch began the meeting by stating that the PBA presented the contract demands on May 4, 2000 and is awaiting for the City to present counter demands.
  • Police Solidarity Day Rally:  Mr. Lynch stated that all delegates and members must attend the rally if we want our message to be heard and show unity in our continuing effort to gain public respect, increased salaries and better working conditions for our members.

COPE

  • COPE Director Robert Zink submitted to all delegates a package containing a list of unregistered members and voter registrations cards.  All members are urged to fill out the voter registration cards and return them to the delegates who will in turn will deliver them to the COPE Committee.

LEGAL ISSUES

  • Report of Stu London:  Mr. London stated that Patrol Guide 118-9 (GO15 procedure) has been changed to Patrol Guide 206-13.   In addition, the Department’s policy regarding false official statements was codified as Patrol Guide 203-8.

Mr. London also stated that cases brought to OATH have been more successful than in the trial room.

The PBA received a victory in the Appellate Division regarding an article 78 proceeding.  The court held that there is no basis for a differential in penalties between officers charged with identical counts where one opts for a trial and the other accepts a plea.

  • Report of Steve Worth:  Mr. Worth stated that the Justice Department has not yet ruled on Federal Intervention with respect to the Street Crime Officers who were cleared on all charges in Albany.

    Mr. Worth also stated that the attorneys would be holding seminars for delegates and officers regarding officers’ rights.

PUBLIC RELATIONS

  • Mr. Lynch stated that he would continue with a massive public relations campaign to make the public and politicians aware of the difficult job police officers do on a daily basis.  All delegates were shown a new advertisement that will be displayed in public shortly.
  • Mr. Lynch also stated that the PBA Tipline is working effectively and that all members should continue to use this important tool.

CONVENTION

  • The PBA Convention will be held at the Hudson Valley Resort & Spa on Wednesday, August 30, to Friday, September 1, 2000.

WALTER LIDDY CASE

  • Mr. Lynch stated that the PBA received a victory in the Midtown South Brothel investigation case by obtaining a preliminary injunction prohibiting the Department from interrogating certain police officers in the case.  The case will eventually go before the Board of Collective Bargaining for resolution. 

CHUCK SCHWARZ DEFENSE FUND

  • Mr. Lynch accepted checks from delegates on behalf of the Chuck Schwarz Defense Fund.  Andra Schwarz the wife of wrongfully accused PO Charles Schwarz spoke to the delegates on behalf of her husband.
