The PBA’s legislative victories are mounting after some intense last minute lobbying by Pat Lynch and Robert Zink, the long list of favorable legislation grew by two, as the Governor signed the Child Care Credit (S6818) and Prior State and City Service Bills (S5938) on December 8, 2000. Keep in mind that the 2000 Legislative Session in Albany was the most successful since the half-pay pension bill was signed in the early 60s.
Here is a brief summary of the two Bills:
Child Care Credit – As the name implies, police officers would have the opportunity to buy back the time spent on child care leave, for up to one year per child. Those members interested in buying back time for past child care leave must make application to the pension section by December 31, 2001.Naturally the member would be required to compensate the pension fund for the contributions that would have been made to the pension fund had no leave been taken. This Legislation became effective as of December 8, 2000 and was enacted into law just for New York City Police Officers.
Prior Service Credit – Legislation permits certain members of the NYC Police Department, hired prior to 6/30/92, the ability to purchase prior service credit from another public retirement system within NYS, if the member was entitled to do so at the time of hire. Prior credit with a NYS retirement system, with the exception of teachers, counts as up front service time. New York City uniformed service (Corrections, Fire and Sanitation Departments) immediately preceding your hire by the police department also counts up front as service time. Other city services and uniformed service not immediately preceding your hire by the police department counts as a monetary benefit after your 20 years of service.
