Minutes of the PBA Delegates Meeting

CALL TO ORDER

PBA President Patrick Lynch called the meeting to order at 11:20

  • Salute to Flag

  • Respects to all fallen officers, seriously injured officers and those who stand wrongfully accused.

  • Recording Secretary Robert Zink reported opening correspondence.

PRESIDENT’S REPORT
Contract Issues

PBA President began the meeting by stating that as of March 9, 2001, the parties to the PERB constitutionality suit have submitted to the Albany County Supreme Court all necessary paperwork.  Oral arguments will be heard on March 23, 2001.  We are not sure how long it will take for the Judge to issue a decision, but we will keep the membership updated.  Mr. Lynch noted that the Teachers Union has also declared impasse and seems to be mirroring the PBA’s strategy.  Mr. Lynch still believes the City is not willing to sit down and seriously negotiate a contract.

On March 8, 2001, NY Supreme Court Judge Stanley Sklar signed the stipulation of settlement in the case of Giuliani vs. Ganley, which affects all former members of the Transit and Housing Police Department who were involuntarily transferred to the NYC Police Department as part of the April 1995 Transit & Housing merger.  All members affected will be notified regarding the terms of this agreement.  Mr. Lynch thanked all Transit & Housing delegates and Trustees who assisted the PBA Attorney’s in this victory.

Legal Issues

Report of Stuart London

  • Mr. London reported that when members are notified by telephone or by letter that a CCRB complaint has been substantiated they should notify the law firm immediately.

  • Mr. London discussed issues concerning the DARP Tow program.

  • Mr. London stated that when an offer is rejected a higher penalty could be imposed after a trial.

  • Mr. London concluded by telling the delegate body to notify the PBA attorneys when dealing directly with the District Attorney’s office.

Health and Welfare Presentation

1.     Health & Welfare Fund Presentation (Carmine D. Russo, Funds Administrator)

Mr. Russo gave an update to the PBA Delegate body for both the Active and Retiree Health and Welfare Funds.  He presented an explanation of City of New York member contributions, benefit expense allocations, fund balances and project fund balances through June 30, 2004.  Various City member contribution scenarios were presented and fund balances relative to each scenario were provided.

2.     NPA Prescription Drug overview (Alan Zimmerman, Senior Executive Vice President, NPA)

Mr. Zimmerman provided the Delegate body with an overview of the PBA’s active and retiree prescription drug program.  A complete overview was provided with respect to trends in prescription drug benefit costs, controlling rising benefit costs, and results of the recent PBA drug plan modifications to both active and retired members.

3.     Davis Vision overview (Dr. Carl Moroff, Executive Vice President and Chief Operating Officer, Davis Vision)

Dr. Moroff provided the Delegate body with an overview of the PBA’s optical program for active and retired members.  National program averages were provided as well as a description of the active and retiree plan designs.  Laser Vision Correction deeply discounted rates available through the PBA was explained.  PBA satisfaction level remains very high.
