Since the Appellate Division handed the PBA a second win in the battle to have this current contract arbitrated before PERB, the City has announced its intention to appeal to The Court of Appeals. We have petitioned PERB to begin the arbitration process while the City appeals.

The City has reacted to our request to have PERB start the arbitration process, before a final determination is rendered by the Court of Appeals, by moving for a Preliminary Injunction. The City asked the Court for a Temporary Restraining Order (TRO) stopping the arbitration process while the Court hears their application for the Preliminary Injunction. The Court of Appeals has DENIED the City’s application for the TRO.

At this point, the City has lost its first attempt to stop the PERB process from moving forward. At the PBA’s request, PERB is currently in the process of appointing a mediator.
