To All Delegates and Members

July 27, 2001

In an effort to correct the Department’s unfair treatment of former Transit and Housing officers who were merged into the NYPD in 1995, the PBA has filed a suit against the City, the Police Pension Fund and the NYPD.

The Department had recently taken the position that former Transit and Housing Officers were not eligible to receive the benefits of certain pension-related statutes passed by the PBA in the New York State Legislature in 2000. In addition, the Department has taken the position that prior City and State time should not be counted for merged Transit and Housing Officers in the same manner as it is for officers directly joining the Department.

In a litigation filed on July 6, 2001, the PBA has challenged the Department’s actions. We will advise you just as soon as the Court renders a decision in this matter.

Fraternally,

Patrick J. Lynch
President
