To All Delegates and Members

January 31, 2002

Status — Ganley, et al. v. Giuliani, et al., Index No.: 118695/95 and Lieutenants' Benevolent Association v. City of New York, Index No.: 112578/95 (1127 Litigation)

The PBA was in court on January 24, 2002 regarding the 1127 litigation.  An attorney from Corporation Counsel's office and a representative of the Comptroller's office represented that interest checks started going out at the end of the week of January 14, 2002, at the rate of about 400 per day.  They also represented that everyone who submitted a W-9 form should have a check by the end of the week of January 28, 2002.

Our members who are eligible to receive interest and who have not filed a W-9 form have until February 8, 2002 to do so.  The Judge has expressed that he will have little sympathy for members missing the deadline.

We strongly encourage all members who are eligible to receive interest from the 1127 Settlement, and have not already filed a W-9 form, to do so.  We should not leave any of our members' money on the table.

If you have any questions, contact your borough Trustees.

Fraternally,

Patrick J. Lynch
