Re: FLSA — OVERTIME ISSUES

As you know, on November 27, 2002, as a result of an investigation commissioned by the PBA, a Fair Labor Standards Act (“FLSA”) lawsuit was commenced against the NYPD and City, alleging violations of federal law. One of the violations is that our members are not being allowed to submit for overtime until they have worked 15 minutes of overtime. We have been advised that that practice is a violation of the FLSA.

Commencing immediately, we are asking members to begin submitting for overtime upon working 7 minutes and 30 seconds of overtime. If you are denied this overtime, hold onto your OT slips for use as evidence in the FLSA lawsuit. If you join the lawsuit, the FLSA attorneys will seek to recoup the wrongfully denied overtime.
