March 20, 2007
We just received word from the Office of Payroll Administration that it has come to their attention that some members of the service affected by the recent Line of Duty Injury FICA settlement who are disputing the amount of LODI wages listed on their forms (e.g., missing periods, amounts, etc.) are not sending in the form and are waiting for their disputes to be resolved. Please note, failure to return the consent form before Thursday, April 5, 2007, will forever bar affected members from collecting ANY of the refund due them. Therefore, the OPA is advising all affected members to circle Y for Yes both for the years included on the form, and for those years that are not included on the form for which they believe that they are owed a refund, even if the dispute has not yet been resolved. This will protect their right to a refund from the IRS should it ultimately be determined after investigation, that they are entitled to a refund for these disputed periods.
NO EXTENSIONS WILL BE GRANTED JUST BECAUSE A MEMBER DISPUTES AN AMOUNT LISTED.
Therefore, we urge all affected members to get your consent forms in before the April 5th deadline.
Consent forms must be mailed or hand delivered to:
Office of Payroll Administration
FICA Refund Claim Unit
1 Centre Street, Room 200N
New York, NY 10007
MEMBERS ON MILITARY LEAVE
We have also been told that OPA is currently working with the IRS to resolve issues regarding requests for extensions for eligible members who are currently serving on Military leave. While the OPA awaits word from the IRS on this issue, for those members who have left a power of attorney, the consent form should be completed signed, and submitted by Thursday, April 5, 2007 by the holder of the power of attorney.
Fraternally,
Patrick J. Lynch
