PBA Files Landmark Federal Lawsuit Against CCRB

Dear PBA Member:

I’m writing to announce a major development in the PBA’s battle against bias and injustice at CCRB.

Today, the PBA filed our first-ever federal lawsuit against CCRB after the agency recently colluded with anti-police activists to release hundreds of inflammatory false and baseless complaints alleging extreme misconduct and criminal acts by police officers. Due to this egregious injustice, the union is now asking the U.S. District Court for the Southern District of New York to declare that CCRB violated our members’ due process rights and order a stop to this destructive agency practice.

*** READ THE LAWSUIT ***

Our lawsuit pertains to three categories of unsubstantiated allegations – sexual misconduct, racial profiling and untruthful statement – that CCRB has released to the public over the past several months. As recently as October 2025, CCRB publicly stated that unsubstantiated allegations in these categories were redacted in the agency’s public disclosures (appearing as “Abuse of Authority: Other”) because they can severely harm an officer’s career and reputation. Despite this public admission, CCRB began quietly releasing the false misconduct claims to activists who have made them public and searchable on the anti-cop database 50-a.org.

When the PBA learned of this despicable and deliberate act of bias and malice by CCRB, we immediately began preparing our federal case. We decided to go through the federal court system, as we believe it is our best venue for receiving a fair hearing. Importantly, this is the first federal due process claim in CCRB’s history, potentially opening the door for future litigation against the deep-rooted culture of bias infecting the entire agency.

As we all know, CCRB’s collusion with anti-police activists was not an accident – it was an intentional, calculated effort to discourage any proactive enforcement in this city by smearing cops with false and baseless allegations.

Through this federal action, we intend to correct this injustice and lay the groundwork for further strengthening our members’ rights down the road. As always, we will keep you informed as this lawsuit moves forward.

In Solidarity,

Patrick Hendry
President
