PBA Sues CCRB – AGAIN – Over Illegal Record Release
Dear PBA Member:
I’m writing to announce another step in the PBA’s battle to root out bias and injustice at CCRB. Today, the PBA filed our second lawsuit in two weeks against CCRB after discovering the agency is flagrantly violating state law by releasing police officers’ records without notifying them.
This state lawsuit – a companion to the landmark federal suit we filed last month after CCRB violated the constitutional due process rights of falsely accused members – alleges that the agency ignored new provisions of the state’s Freedom of Information Law (FOIL) requiring CCRB to notify police officers when their disciplinary records are requested through the FOIL process.

We are asking the state court to rule that CCRB’s illegal releases via FOIL violate our members’ notification rights protected by law. We are also seeking an immediate halt to CCRB’s processing of any new FOIL request containing officer personnel information until an adequate policy is in place.
As you already know, CCRB’s disregard for officer rights is nothing new. However, these recent lawsuits are part of an escalating campaign by the PBA to expose CCRB’s toxic culture of anti-police activism and highlight the dangers this agency poses to public safety.
Through these efforts, we intend to highlight CCRB’s complete lack of credibility and hold the activists at the agency accountable for their shameless disregard for the law. As always, we will keep you informed as this lawsuit and our federal suit against CCRB move forward.
